Terms of Service

The conditions under which ASL Logistics B.V. carries, monitors, and hands off your freight, and under which you use this website and its tracking, quote, and contact facilities.

1.

The agreement

These terms govern your use of this website and, together with the booking confirmation and transport documents issued for each shipment, the services provided by ASL Logistics B.V. (“ASL”), a company registered in the Netherlands with its head office in Rotterdam. Where a signed service agreement or a transport document (bill of lading, air waybill, consignment note) conflicts with these terms, that document prevails for the shipment it covers.

By requesting a quote, booking a shipment, or using this site, you accept these terms on your own behalf and, where you act for a company, on that company’s behalf.

Services

ASL provides freight forwarding across ocean, air, and road modes, warehousing, and shipment monitoring: telemetry-equipped carriage with geofence supervision, sensor reporting, and automated status updates from gate to gate. Unless we expressly agree otherwise in writing, ASL contracts as a freight forwarder — arranging carriage with carriers on your behalf — and not as a carrier itself.

Quotes and bookings

Quotes issued through this site or by our team are indicative and remain open for fourteen days unless the quote states otherwise. They are based on the shipment particulars you supply and on rates, surcharges, and exchange rates current at issue. Carrier general rate increases, fuel and security surcharges, demurrage, detention, and storage arising after issue are passed through at cost. A booking is confirmed when we issue a booking confirmation, not when a quote is requested.

Monitoring and tracking data

Positions, sensor readings, and ETAs shown on the tracking page are produced from device telemetry, carrier feeds, and port systems. We work to keep them accurate and current, but telemetry can lag, drop, or be unavailable in signal-poor segments of a route. ETAs are estimates, not guaranteed delivery times, and geofence or sensor alerts are an operational aid, not a warranty of cargo condition. Decisions with financial consequences — resale commitments, production scheduling, letters of credit — should not rest solely on the public tracking display.

5.

Your obligations

You are responsible for:

  • accurate and complete shipment particulars: description, weight, dimensions, value, and any dangerous-goods classification;
  • packing adequate for the mode and route, unless packing is expressly part of our engagement;
  • the accuracy of customs documentation and the legality of the goods in origin, transit, and destination countries;
  • not tendering prohibited items: undeclared dangerous goods, contraband, currency, live animals, or goods subject to sanctions on the routing concerned;
  • paying our invoices within the agreed terms; we may exercise a lien over cargo and documents for unpaid charges where the law allows.

Losses caused by inaccurate declarations — including fines, demurrage, and reinspection costs — are for your account.

6.

Liability

Carriage is subject to the international conventions and national laws that mandatorily apply to the mode and route concerned — including, as applicable, the Hague-Visby Rules for ocean carriage, the Montreal or Warsaw Convention for air carriage, and the CMR Convention or corresponding national road transport law. Where such a regime applies, our liability and the carrier’s liability are limited as that regime provides.

Where no mandatory regime applies, ASL’s liability for loss of or damage to cargo is limited to the lower of the declared value and 2 SDR per kilogram of the goods affected, and we are not liable for indirect or consequential loss, including loss of profit or market. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for our own fraud.

Claims must be notified in writing within the time limits of the applicable transport document or convention; where none applies, within fourteen days of delivery or expected delivery.

7.

Insurance

Freight forwarding charges do not include cargo insurance. We can arrange all-risks cargo insurance on request, at declared value, before the shipment moves. If you decline insurance, the cargo travels at the liability limits in section 06.

8.

Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control: port closures and congestion, strikes, weather, war, piracy, epidemic controls, customs stoppages, or failures of public infrastructure. Where such an event affects a monitored shipment, our obligation is to report the disruption through the tracking feed and to reroute or hold cargo as a prudent forwarder would.

Website use

You may use the tracking page only for shipments in which you have a legitimate interest. Automated scraping of tracking data, probing of the site’s interfaces, and submission of false quote or contact requests are prohibited. Content on this site — text, imagery, and design — belongs to ASL or its licensors and may not be reused without permission. Personal data submitted through the site is handled as described in our Privacy Policy.

10.

Governing law

These terms are governed by the laws of the Netherlands, and the courts of Rotterdam have exclusive jurisdiction, except where a mandatorily applicable transport convention or a signed service agreement provides otherwise.

Changes and contact
